The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the tension sparked by the introduction of a new 28-point plan for ending the war appeared – momentarily – to have been defused. A American diplomat spoke of "significant advancement" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: a renewed assault of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The sequence of conflicting incidents captured the grim essence of the outgoing year. By day, negotiation efforts are conducted: positive announcements are delivered from different nations. Considerable effort is expended on containing particular approaches. By night, Russian leadership brutally reminds the world that, for them, war remains the main instrument for achieving "resolution".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was exposed. Ukraine is capable of detecting rocket firings from across the border, a capacity afforded by up-to-date information. From vantage locations, defense planes that had been dispatched to engage hostile aerial threats streaked across the sky – advanced fighter aircraft provided to Ukraine by European allies.

Shortly after, Kyiv's anti-aircraft weapons activated: defensive missiles targeted at a Russian ballistic missile. This was a modern interception technology at work, probably provided by allied countries. Every deployment shakes the surroundings, causing tremors. The instant of fear quickly transforms into grim resignation: maybe the incoming missile won't hit its mark this time, preventing destruction from catastrophe and another blackout.

Ongoing Risks

Following this, a heavy machine gun fired at a drone close by, part of a defensive team – probably imported technology. Unfortunately, the shots failed to hit the opposing UAV – it pressed on overhead toward its destination.

Intermittently, this carried on until dawn. Kyiv greeted the morning news: several casualties, damage and utility failures in numerous residences as a result of the nocturnal offensive. As always, everyone still went about their day – living the war. But those full day demonstrated Ukraine's critical military reliance on Western support – a dependence that European nations are clearly incapable to substitute in the short term.

Failed Diplomacy

The comprehensive proposal from American leadership provoked deep reactions, debate and deep concern – and temporarily diverted attention from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after previous diplomatic encounters and international summits.

Every new initiative from US leadership follows the same pattern: a diplomatic cavalry charge against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually achieve victory. This trend will, no doubt, persist.

Tactical Assessments

It is tempting to accuse certain parties of repeatedly advocating Russian terms. But that does not seem to be the complete picture. American leadership functions according to a principle familiar among international relations experts: you cannot secure via talks what you have lost on the battlefield. The White House believes that it is unrealistic to pressure the Kremlin to relinquish the areas that it presently holds in Ukraine's south or east.

The challenge is that while recognising this factual reality, Washington does minimal to deter Moscow, through statements or actions, from thinking that the current condition will not evolve additionally in its advantage in the months ahead.

Opposing Positions

Therefore, Moscow is convinced that the clock favors them – that Ukraine and its partners are coming close to fatigue. Their reason to agree to terms that does not give them the greatest potential benefit is almost completely absent. There may be many attempts to stop fighting, but they will persist as long as Russia's leadership remains supremely confident in the result.

On the contrary, Ukrainian leadership believes that Ukraine can still hold out, slowly losing people and territory but averting a entire defensive failure until situations evolve in its advantage.

Existing Situation

Objectively, there are no real preconditions for a truce. Now, personal considerations are becoming relevant: political desires to broker a ceasefire and obtain worldwide acknowledgment, and Ukrainian leadership's double obstacles – on one hand, not to distance important partners, and on the other, to mobilize citizens around the flag against any plan Kyiv finds unacceptable, so that their focus does not shift toward homefront challenges. And although their mission will now be much harder after latest incidents, it remains very improbable that this will alter their fundamental strategy.

These two forces are influencing discussions.

Summary and Prospects

It took a mere seven days to kill the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by American leadership, pushback by Ukraine and the remaining European nations, along with pacifying measures of representatives, and finally, current information leaks, all did their job.

While new proposals based on old ideas are forthcoming, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to counter negotiation assaults from Washington that are based on Russian demands and reflect specific hesitation to modify developments, if they remain united and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's capacity to counter nocturnal attacks will, for the predictable period, largely rely on ongoing international assistance.
